A small company in Japan won the jurisdiction decree against US giant “Apple “

A small company won the jurisdiction decree with Tokyo district court against US-based IT giant “Apple “ on 16 February 2016. The provision of the contract had stated expressly that the parties shall submit to the exclusive jurisdiction of the US court. However the Tokyo court handed down that the provision of the contract should be nullified because of abuses of the dominant position of Apple. The lawsuit will resume.
To begin with, the complaint is stating as follows: As Apple offered the increase of production , the company accepted it and invested in plant and equipment. However Apple demanded to reduce the quantity of the products drastically just after the investment. The company was surprised to ask to withdraw the reduction, but reversely Apple demanded to reduce half the price in place of the quantity reduction, and in addition demanded to reduce the price of the products the company had already delivered. So the company filed the above compensation lawsuit with Tokyo district court against the giant “Apple”.

Seoul court clears a Japanese journalist in libel case.

The Seoul Central District Court cleared a Japanese journalist , former Seoul bureau chief of Japan’s Sankei Shinbun newspaper, of defaming the South Korean president.
He was arrested in October last year. The prosecutor said that a report he wrote in August over President Park Geun-hye’s whereabouts during a ferry disaster was based on false information, had no foundation and damaged her honor.
The presiding judge said that It is difficult to conclude that the defendant intended to defame the president or libel her as a public figure. The court might have viewed that the conduct of the defendant was in the realm of freedom of the press.

Mizuki died at 93

Cartoonist Shigeru Mizuki died on November 30th in a Tokyo the age of 93. He was globally known for his " GeGeGe no Kitaro" series depicting "Yokai "( the spirits and monsters of Japanese folklore), and a 1973 manga based on his battle field experiences depicting the horror of war , such as " Soin Gyokusai " ( Onward Toward Our Noble .Death ).
In 2009, he won the Heritage Essential Award of the Angouleme at the International Comics Festival in France.

A troubled fast breeder reactor might be scrappled

The Nuclear Regulation Authority (NRA) in Japan made its official request with the education and science ministry to replace the government-backed Japan Atomic Energy Agency (JAEA) to operate the troubled facility, the Monju prototype fast-breeder reactor.
On top of this, the NRA asked the ministry to conduct a fundamental reconsideration of Monju project if it fails to do so within 6 months.
Monju is Japan’s sole fast breeder reactor, which can produce more plutonium fuel than it consumes to generate electricity. Many industrialize countries such as U.K. and Germany gave up developing it due to the technical and cost hurdles, while Russia , China and India are still eager to develop it.

Nissan Motor Company has found that an air bag made by Takata Corp blasted abnormally injured a passenger in a Nissan vehicle last month. The transport ministry announced that it was the first case causing injuries in Japan. The vehicle was a Nissan X-Trail sport utility produced in 2006. The recall was delayed due to a lack of replacement parts although it was taken to a dealer in August.

The Tokyo District Court on Monday nullified a decision by NHK (Japan Broadcasting Corporation) to rescind the contract with a French anchorwoman and ordered NHK to pay her YEN 5.14milion in unpaid salary. She evacuate Japan temporarily during the Fukushima nuclear March 2011. According to the ruling, prior to departing, she asked her colleague, a veteran French anchorman, to substitute for her, so her absence cause no serious trouble. Her superior gave her an approval of fleeing nation.

Chinese company set to buy Hokkaido ski resort

A Chinese company will acquire all shares of Hoshino Resorts Tomamu, a resort in central Hokkaido known for its powder snow, from Hoshino Resorts Inc. and a foreign investment fund for YEN 18.3 billion. The purchasing company is Shanghai Yuyuan Tourist Mart which is a unit of Shanghai-based conglomerate Rusan Group which has taken control of a French holiday company known as Club Med.
